What is the Texas Homestead Exemption & Who Qualifies?

What it used to be prior to January 1, 2022: A homeowner, who claimed a property as their principal residence could apply the following year between January 1 to April 30.

What it means as of January 1, 2022: As part of property tax relief, homeowners may now apply for a homestead exemption the same year.

Qualifications for Texas Homestead Exemption

Beginning January 1, 2022, homeowners are allowed to file and be granted a homestead exemption immediately after closing if the Seller did not previously have a homestead exemption for the current tax year. You should also have your drivers license updated to reflect your new principle residence . Other homestead exemption criteria:

  • The homeowner, nor their spouse, have not claimed another residence for homestead exemption.
  • If the homeowner moves away and they do not establish a homestead exemption elsewhere, they still qualify if they return to the principal residence in less than two years.
  • For military Texas homeowners in service, they may exceed the two year period. This also applies for military who are in a facility that provides services related to aging, health, or infirmity.
